The filing of a charge with the Equal Employment Opportunity Office is a prerequisite to an employee (or former employee)’s filing a lawsuit. The EEOC will always ask for the company’s position through a formal “position statement.” What you say in this position statement can make all the difference in whether the EEOC decides to file suit against your organization.
